"LOL LOL LOL Sussmann filed today to have significant portions of Marc Elias's testimony stricken from the record and also moved for a mistrial."

The documentation.

--------------------------------

Thoughts on the above:

NOW I understand what was up with Elias’s answer and the kerfuffle that followed.

It was good to read the reporter’s takes on today’s trial, but NONE that I have read did a good job of communicating this drama.

The implication of Elias’s answer, “you would have to ask Mr. Sussmann.”, is that Sussmann SHOULD testify to that effect. He has the RIGHT NOT TO.

Put into a different context: How many times in your marriage has there been an exchange where your husband or wife answered a question from a friend/relative with,

“You’d have to ask her/him about that.”

Get it?

Judge Cooper said at the end of the day that he “is not inclined to a mistrial”, but I would not be surprised if he strikes that portion of Elias’s testimony.

The blame for this is on Elias, who is a witness for the Prosecution, but, for obvious reasons, is not a friendly one.

I really think Sussmann switched to ‘knives out’ mode after Joffe refused to testify on his behalf.

Can’t blame Joffe for that; he is still under investigation by the SCO.

Sussmann’s defense team is defending him, but also defending the people behind him (Joffe, Clintons, Fusion, etc.)

If Sussmann wanted to protect those people, he’d have plead guilty/no contest and prevented all of this (the filings, the piercing of attorney client privilege, etc etc)

Instead, Sussmann is trying to save himself, so Elias pulled this stunt.

But hey, I am no lawyer. I am just a human, following this case as best I can.

From Techno Fog.

Baker testifies he is 100% certain that Sussmann lied.

And - how Sussmann set up Baker with the New York Times to spur interest in the Alfa Bank hoax.

Day 3
of the Sussmann trial - Baker testifies

I’m on the road the next few days (wedding season) and will be providing updates on the Sussmann trial that have more transcripts and less discussion from your humble author.

Today, it’s the morning testimony of former FBI general counsel James Baker. Yesterday we discussed how Sussmann reached out - not on behalf of a client - yo share the purported Alfa Bank/Trump data. Here he discusses what occurred during that fateful meeting in September 2016.

Cats in a litter box. Perfect analogy.

It is telling that Durham was left alone to complete his investigation without any opposition or blowback from the current administration.

Scam investigation, followed by a show trial, that will accomplish nothing.
The day after the trial, it will be business as usual.

I am still hoping for curveballs and plot twists, but at the moment it is looking like a badly scripted school play.  Popnana

It's fair to ask after 3+ years of the Special Council, where is this going and when is it going to get there! It's also fair to ask if the justice system in this country is capable of fulfilling its mission under the law.

The charges against Sussmann and Danchenko are for lying to the FBI, not any other potentially criminal act associated with RussiaGate. Considering that Clinesmith, the only other person to be charged by Durham, who received 12 months probation for altering evidence presented to get a warrant, already implicates the FBI in a larger conspiracy, I don't think that a Sussmann conviction gives them much cover.

I think the reason for this minor charge against Sussmann is to eliminate any argument of attorney client privilege of documents sought under subpoena from the DNC and Hillary Campaign. Where that leads, considering all the information of criminal actions that already exists in the public domain, and how many more years it will take to bear fruit, if any, remains to be seen!

We all know there are much bigger fish to fry, but I have to question if the system is too broken to bring any of them to justice!

Quote:"Justice delayed is justice denied" is a legal maxim. It means that if legal redress or equitable relief to an injured party is available, but is not forthcoming in a timely fashion, it is effectively the same as having no remedy at all.

This principle is the basis for the right to a speedy trial and similar rights which are meant to expedite the legal system, because of the unfairness for the injured party who sustained the injury having little hope for timely and effective remedy and resolution. The phrase has become a rallying cry for legal reformers who view courtstribunalsjudgesarbitratorsadministrative law judges, commissions[A] or governments as acting too slowly in resolving legal issues — either because the case is too complex, the existing system is too complex or overburdened, or because the issue or party in question lacks political favour.

Here’s a development.

On the stand Clinton campaign manager Robby Mook admitted that Hillary approved the release of material to the media.
